This module is intended to familiarize course participants with the different forms of dispute resolution relevant to the restructuring and insolvency context. First, the module provides an overview of the Singapore court system along with litigation procedures and considerations for claims and assessments in the context of (i) liquidation; (ii) judicial management; and (iii) schemes of arrangement.
The module also introduces various forms of Alternative Dispute Resolution, including arbitration, mediation and expert determination, and considers how these mechanisms may be used in insolvency scenarios.
This module is part of the Advanced Certificate in Insolvency and Restructuring.
LEARNING OBJECTIVES

- Expert Determination
- Understand third-party litigation funding and its application in insolvency proceedings

PREREQUISITE
Participants should preferably be a degree holder, in any discipline, and have at least one year of working experience.
ASSESSMENT
As part of the requirement for SkillsFuture Singapore, there will be an assessment conducted at the end of the course. The mode of assessment, which is up to the trainer’s discretion, may be an online quiz, a presentation or based on classroom exercises.
Participants are required to attain a minimum of 75% attendance and pass the associated assessment in order to receive a digital Certificate of Completion issued by Singapore Management University.

Victor Yao
Victor Yao is a Senior Associate in the Litigation and Dispute Resolution practice of Cavenagh Law LLP. A former Justices’ Law Clerk, Victor has acted for clients in a wide variety of high-value and complex international commercial arbitration matters across a range of sectors and applicable laws. Victor also has an active litigation practice and has appeared at all levels of the Singapore courts, including the SICC.
Deborah Loh
Deborah Loh is a Senior Associate in the Litigation and Dispute Resolution practice at Clifford Chance in Singapore. Deborah has experience in litigation at all levels of the Singapore courts, as well as high-value and cross-border arbitrations. She has also assisted in complex investigations and employment matters in the APAC region. She was admitted to the Singapore Bar in 2017 and as a solicitor of the Senior Courts of England and Wales in 2022. In 2023, she passed Level 1 of the Chartered Financial Analyst program.
